TERMS & CONDITIONS
These Booking Terms & Conditions (“Booking Terms”) are made between THE EGG VENUE (“THE EGG VENUE” or “we” or “us”) and the Retreat Organiser named on the Booking Form overleaf (“you” or “the Organiser”).
The Booking Form and these Booking Terms constitute an agreement (the “Agreement”) between us and you in relation to your booking and use of the Retreat Centre for a retreat to your clients.
Any reference to conduct comprising any obligation or breach under this Agreement by you, is equally applicable to any conduct undertaken by your agent, representative, employee or person otherwise acting in your stead.
1. BASIS OF CONTRACT
1.1 These Retreat Organiser Booking Terms & Conditions and the Booking Form (the “Agreement”) set out the terms and conditions upon which we are prepared to let you use the Retreat Centre to provide a Retreat to your Clients and constitute the entire agreement and understanding between us in relation to the booking of the Retreat Centre and supersede all other agreements, arrangements and understandings between us in relation to its subject matter. By signing the duplicate of this letter you agree that the terms of the Agreement shall apply to the booking and use of the Retreat Centre to the exclusion of any terms and conditions contained in any of your own documents and that you have not relied on any representations or warranties which are not expressly set out in the Agreement save that this clause does not limit or exclude any liability for fraud.
1.2 To the extent that there is a conflict between the provisions of this letter and the General Terms of Lease of the Retreat Centre, the provisions of this Agreement shall prevail. Words defined in the Booking Form shall have the same meaning in these Retreat Organiser Booking Terms & Conditions.
2. GENERAL TERMS OF LEASE OF THE RETREAT CENTRE
2.1 The general terms of the lease agreement between us and the owners of the Retreat Centre will be (in so far as they apply) complied with by you at all times and you will take reasonable steps to ensure you comply with the general terms of the lease.
2.2 The General Terms of the Lease include the following:
(a) No pets – it is forbidden to bring pets to the Retreat Centre
(b) Whilst all reasonable attempts have been made to make the Retreat Centre as safe as possible, there are natural hazards. You need to conduct yourself in a prudent manner.
(c) Arrival and Departure: The Participant is requested to arrive on Saturday after 2pm and vacate the Hotel by 12pm on the day of departure (Saturday) unless otherwise agreed. Breakfast buffets for the groups can be arranged in-between 7:30am and 10:30am.
(d) The Retreat Centre you are staying in is provided in good condition, tidy and clean and completely furnished. You undertake responsibility to use the property with due diligence, and leave the property on the expiry date agreed, in the same state it was received, tidy and clean. On arrival, if you do not wish to accept the state of the property, you must make a formal complaint in writing immediately to the THE EGG VENUE representative.
(e) The Retreat Centre will be cleaned prior to guest arrival, daily in the mornings, late afternoons, after each session and upon departure of the guests.
(f) The Retreat Centre Owner will not be responsible in the case of lack of water and/or power supply, gas or other unforeseen events beyond the Owner’s will or circumstances beyond their control.
(g) Mosquitoes, lizards, wasps, bees and other insects are endemic residents. They are attracted by human presence and can be found in the Retreat Centre. This is considered normal and the presence of any quantity of bugs in the Retreat Centre in the outdoor areas shall not give rise to any liability of the Owner, or right to terminate the Agreement.
(h) The Retreat Centre has an outdoor changing room but you are responsible for ensuring the security of your belongings.
(i) Should problems arise during the retreat, you are responsible for informing the retreat organizers or THE EGG VENUE representative immediately. Inconveniences do not entitle you to a refund or compensation. Complaints lodged at the end of or after your retreat will not be taken in consideration.
(j) As far as is possible, faults occurring in technical or other equipment provided will be dealt with immediately. Payments must not be withheld or reduced as a result of such faults.
(k) THE EGG VENUE provides you with open-air Workshop areas. The main workspace is covered by a wooden roof. In case of strong winds, rain and/or thunderstorms we might ask you to leave the Retreat Centre in behalf of your own safety. Any lost sessions/lessons will be lost. Payments must not be withheld or reduced as a result of such faults.
(l) Laundry facilities are not available. In case you need to wash, please bring some hand washing powder with you.
(m) Any damage to the fabric and fittings of THE EGG VENUE arising from the activities of your event or its attendees will be charged to you.
(n) You may be asked to produce evidence of appropriate PAT testing for any electrical equipment you bring in to THE EGG VENUE. THE EGG VENUE may insist that uncertified equipment be removed.
USE
3.1 You may use the Retreat Centre to provide a retreat to the persons, the details of which you submitted with the Booking Form (the “Clients”) subject to and in accordance with the Agreement. If the details of the persons are not known at the time of submitting the booking form, they must be supplied prior to the start of the retreat. You will not have a confirmed booking and we may refuse to allow you to use the Retreat Centre until we receive such details.
4. BOOKING
4.1 The Booking Form is your offer to book the Retreat Centre subject to and in accordance with the Agreement.
(a) We may accept or reject the Booking Form at our discretion.
(b) We are not obliged to accept a booking.
(c) The Agreement is binding on you when we have accepted it in writing.
4.2 The Agreement will not be binding on us until:
(a) we receive the signed and properly completed Booking Form together with a completed Participants Form in relation to each Client. (If the details of the persons are not known at the time of submitting the booking form, they must be supplied prior to the start of the retreat): and
(b) we receive the required booking payment in cleared funds; and
(c) we have issued an E-Mail confirming your booking.
5. RETREAT: YOU AND YOUR CLIENTS
5.1 The Agreement for the provision of the Retreat Centre for the purposes of your providing a Retreat to your Clients is between you and THE EGG VENUE. You are primarily responsible to THE EGG VENUE for all payments in relation to the Retreat Centre and the conduct of your Clients.
5.2 You shall only allow the Clients identified by you in the booking form (or supplied prior to the start of the retreat) to attend your retreat and stay at the Retreat Centre.
5.3 You are responsible for the acts and omissions of all persons you allow to access the Retreat Centre including without limitation your Clients. You shall procure that all such persons are aware of and agree to all rules and regulations in relation to their conduct and obligations while at the Retreat Centre including with- out limitation the general terms of Lease as advised to you in this Agreement.
5.4 You are responsible for checking that the persons who attend your retreat at the Retreat Centre are physically able to do so and that doing yoga, dance or other sportive exercises will not be harmful to the health of those persons. You are also responsible for the health and safety of those individuals while they are participating in any yoga, dance or other session organized by you or on your behalf. You indemnify us with regard to your responsibilities set out in this clause 5.4.
5.5 You will otherwise ensure each of your Clients completes and signs the Participant Form and supply copies of each Participant Form to THE EGG VENUE at least three weeks prior to the start of the Retreat.
6. PAYMENT
6.1 You must pay the Initial Deposit of 1.500 Euro via wire transfer if you submit the Booking Form. A non-refundable administration fee of 500,00 Euro of the total amount is required for your booking to be confirmed. This amount is applied to your total cost.
6.2 You must pay the Second Deposit of 25% of the total rental rate due 5 months prior to the start of the Retreat via wire transfer to the THE EGG Venue bank account.
6.3 You must pay the Third Deposit of 25% of the total rental rate due 4 months prior to the start of the Retreat via wire transfer to the THE EGG Venue bank account.
6.4 The final balance of 50% of the total rental rate of your booking of the Retreat Centre must be paid due 6 weeks prior to the Retreat start payable via wire transfer to THE EGG Venue bank account. Final payment must be received by us not less than 6 weeks prior to the start date of your Retreat.
6.5 Further, if you have not paid in full and on time we reserve the right to treat your booking as cancelled by you. In this case the cancellation charges set out in Section 7 will be payable.
6.6 LATE PAYMENTS
We must pay our tour operators and the Hotel in advance; therefore we must collect your full payments no later than the 5 month/5 month/6 weeks in advance of the start of the Retreat. If you do not pay the full of all deposits on time, we will add 100,00 Euro late payment fee to your invoice.
7. CANCELLATION
7.1 You may cancel your booking if it has been confirmed by us by notice in writing (a “Cancellation Notice”). Your Cancellation Notice will take effect on the date we receive it at our offices (the “Cancellation Date”), or via E-Mail to info@the-egg-greece.com
7.2 IF YOU EXERCISE YOUR RIGHT TO CANCEL YOUR BOOKING UNDER CLAUSE 7.1, CANCELLATION CHARGES WILL APPLY as detailed in Clause 7.3.
7.3 We incur costs from the time we confirm your booking and may be unable to re-sell the period for which you have booked the Retreat Centre if your booking is cancelled. Accordingly, if you wish to cancel your booking pursuant to Clauses 7.1, 7.2 and 7.3, the following cancellation charges will apply: Period of time from (and including) the date of the Cancellation Notice to (and including) the start of your retreat Cancellation

7.4 The above cancellation policy applies to cancellation of your entire booking of the Retreat Centre or for cancellation by any individuals within your party. If the number of Clients participating in your retreat falls below 10 you must still pay the total cost for 10 Clients, unless otherwise agreed in writing with THE EGG VENUE.
8. ACCOMMODATION AND RETREAT CENTRE PRICING
8.1 Accommodation for you and your Clients detailed in the Booking Form, will be provided next to the Retreat Centre which is equipped as described in the Retreat Centre website, subject to and in accordance with the General Terms of Lease.
8.2 The minimum number of retreat guests is 10 plus teacher(s). The maximum number of retreat guests is 28 plus teacher(s).
8.3 With 20-28 retreat guests, up to 2 teachers stay for free in one Standard Double Room. With 10-19 retreat guests, 1 teacher stays for free in a Standard Single Room.
8.4 The standard price applies for bookings from 10 to 14 retreat guests (plus teachers)
8.5 The Volume Incentive Discount applies for bookings from 15 to 22 retreat guests (plus teachers).
8.6 As a retreat organizer, you are free to add your mark-up to our price to cover your costs, teaching fee and any other expenses involved in organizing the retreat.
8.7 Retreat pricing is set out in in our booking form and includes breakfast buffet at the Hotel, vegetarian-organic lunch buffet at THE EGG VENUE, accommodation at the Hotel and daily use of THE EGG VENUE from 6:00am to 9:00pm (on request other time frames). The prices quoted are per person per week (7 nights) and are inclusive of VAT and all taxes. Dinners, airfares, transfers from and to the Hotel are not included.
09. INSURANCE
All participants must be covered by their own travel insurance to include personal loss, damage or injury and all activities that they decide to participate in during their holiday. We will not be liable for any loss, damage or injury. Your holiday travel insurance should cover these and other contingencies. We accept no liability for: cancellation, delays or changes caused by war, threat of war, closure of airports, industrial action, natural disaster, technical problems to transport, staff cancellations or other events beyond our control, participants’ medical or psychiatric conditions which may develop during or subsequent to the holiday, loss of, or damage to, personal property or participants. We recommend that you take out adequate travel insurance, including cover for medical treatment, accidents and repatriation, and holiday cancellation and curtailment.
It is your responsibility that you arrange, or ensure you have appropriate comprehensive travel insurance. This to include cover for illness, personal injury and travel delay/cancellation. We assume that such a policy is in force before you depart. You should bring the policy with you in case of an emergency.
10. HEALTH
Please consult your doctor, prior to your holiday, if you have any health problem which may interfere with your ability to take part in the retreat, as it is your responsibility to be adequately fit. A first-aid supply will be taken on outdoor excursions but the leader is not medically qualified and any treatment will only be given with your express consent. Be sure to carry any specific personal medication at all times.
11. STATUS
11.1 You will be an independent contractor and nothing in the Agreement shall render you an employee, worker, agent or partner of THE EGG VENUE or the Retreat Centre and you shall not hold yourself out as such.
11.2 You shall be fully responsible for and indemnify us against all liability, assessment or claim for:
(a) taxation whatsoever arising from or made in connection with the provision of the Retreat to Clients, where such recovery is not prohibited by law;
(b) any employment-related claim or any claim based on worker status (including reasonable costs and expenses) brought by you or any substitute against us arising out of or in connection with the provision of the Retreat, except where such claim is as a result of any act or omission of us. We may satisfy such indemnity (in whole or in part) by way of deduction from any payment due to you.
12. SAFETY WARNINGS
Whilst all reasonable attempts have been made to make the Retreat Centre as safe as possible, there are natural hazards. You must ensure that you conduct yourself in a prudent manner and you shall procure that all person to whom you allow access to the Retreat Centre also do so.
13. LIMITATION OF LIABILITY: YOUR ATTENTION IS SPECIFICALLY DRAWN TO THIS CLAUSE
13.1 This Clause 13 sets out the entire liability of THE EGG VENUE or the Retreat Centre (including any liability for the acts or omissions of its employees, agents, consultants and subcontractors) to you in respect of:
(a) any breach of the Agreement;
(b) any use made by you or your clients of the Retreat Centre or any associated facilities or any part of them; and
(c) any representation, statement or tortious act or omission (including negligence) arising out of or in connection with the Agreement.
13.2 All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Agreement.
13.3 Nothing in the Agreement limits or excludes the liability of THE EGG VENUE or the Retreat Centre:
(a) for death or personal injury resulting from its own negligence;
(b) for any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation by THE EGG VENUE or the Retreat Centre; or
(d) for any damage or liability incurred by you which THE EGG VENUE or the Retreat Centre cannot exclude by law.
13.4 Subject to Clause 13.3 THE EGG VENUE and the Retreat Centre shall not be liable for:
(a) loss of opportunity;
(b) loss of anticipated saving; or
(c) loss of business; or
(d) loss of use; or
(e) loss of goodwill or
(f) any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses and, subject to Clause 13.3, THE EGG VENUE and the Retreat Centre’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of the Agreement shall be limited to the charges actually paid by you in respect of the Booking.
13.5 Subject to Clause 13.3, THE EGG VENUE and the Retreat Centre are not liable for any loss or damage attributable to your own fault or third parties. For example, without limitation, THE EGG VENUE and the Retreat Centre are not responsible for loss or damage to property or goods where that loss or damage is caused by you or a third party.
13.6 THE EGG VENUE and the Retreat Centre do not accept any liability for damage or liability arising out of or in connection with acts, events, omissions or non-events beyond its reasonable control, including acts of God, fire, flood, earthquake, storm, rain or other natural disaster, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, breaking off of diplomatic relations or similar actions, acts of terrorism, threats of acts of terrorism, adverse weather conditions, closure of airports, explosion, accidental damage, failure of third party service providers, telecommunications failures, electrical outage, strikes, lock outs, industrial action or the refusal of you to co-operate with it, civil strife, industrial action, natural disaster, psychiatric conditions which may develop during or subsequent to the Retreat, injury sustained during the Retreat or loss of or damage to personal property of participants.
14. TERMINATION
We may terminate the Agreement (in addition to any of its other rights or remedies) forthwith and without liability if:
(a) you are in material breach of any of its obligations under this Agreement; or
(b) you become insolvent or bankrupt or are unable to pay your debts when they fall due (or the equivalent in any jurisdiction) or a court of competent jurisdiction makes an order to that effect or if you enter into any voluntary arrangement with your creditors or become subject to an administration order (or the equivalent in any jurisdiction).
Termination of the Agreement shall be without prejudice to any accrued rights and remedies, and any provisions which are by their nature intended to survive such termination shall do so.
15. ASSIGNMENT
15.1 You may not resell, assign, transfer, encumber or otherwise dispose of or subcontract any of its rights or obligations hereunder without the prior written consent of THE EGG VENUE and any attempt to do so will entitle THE EGG VENUE to terminate the Agreement without prejudice to THE EGG VENUE's other rights and remedies. You may only allow those of your clients detailed on the Participant Form to use the Retreat Centre subject to and in accordance with the terms of the Agreement.
15.2 THE EGG VENUE shall be permitted to assign, sub-contract or otherwise deal with its rights and obligations under the Agreement.
16. WAIVER
No waiver (whether express or implied) by either party of any of the provisions of the Agreement or of any breach of or default by the other party in performing any of those provisions shall constitute a continuing waiver and no such waiver shall prevent that party from enforcing any of the provisions of the Agreement or from acting upon any subsequent breach of or default by you under any of the provisions of the Agreement.
17. SEVERABILITY
If any one or more of the provisions contained in the Agreement shall be deemed by any Court or other competent authority to be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions of the Agreement shall not in any way be affected or impaired thereby.
18. GOVERNING LAW AND JURISDICTION
18.1 This Agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with Greek law.
18.2 The courts of Greece shall have exclusive jurisdiction to settle any dispute or claim arising out of this agreement.
19. NOTICES
19.1 All notices must be given in writing and delivered
(a) in person;
(b) by email to info@the-egg-greece.com or
(c) to such other address as either party may from time to time specify in writing to the other party and shall be effective only upon delivery.
19.2 If a Notice is delivered after 5pm on any day, the Notice will be deemed to have been received at the commencement of business on the next business day.
20. RETREAT TIMES
Our retreat times and the use of the THE EGG VENUE all run from Saturday 4pm to Saturday 9:30am.
21. ALTERATION POLICY
We reserve the right to alter arrangements and programmes due to factors beyond our control such as, but not limited to, weather conditions or any other problems where we deem such alteration to be in the best interests of our clients. If changes occur they will be made known to clients as soon as possible.
22. ARRIVAL AND DEPARTURE TIMES
Guests rooms will be ready from the start of the retreat date(s) in the Hotel. If you arrive before the designated dates, or depart outside the designated retreat dates we are not responsible for your accommodation. If your flight is delayed or cancelled, you are required to contact us immediately.
On your departure day please be ready to leave the retreat by 12pm. All guests must have vacated the accomodation by 12pm on the day of departure. Between 12pm to 2pm our cleaners fully check, clean and prepare the accomodation in the Hotel for the next retreat.
23. Swimming pool at the Hotel
Please note that swimming pools carry their own inherent risks. Upon arrival at the property you and all members of your party must take time to familiarise yourselves with the location, layout, depth. Young children must not be allowed to wander unaccompanied in the grounds, and must be closely supervised at all times, it is your sole responsibility.
24. AIRPORT / PORT TRANSFERS / TRANSPORTATION
We do not offer transfers from the Aiport or ports (Evidlos and Agios Kyrikos) to the Hotel and back. The drive from the Ikaria Airport to the Hotel is 1,15 hours one-way. The drive from Agios Kyrikos port to the Hotel is 1,15 hours one-way. The drive from Evdilos port the Hotel is 20 minutes by car or taxi.
25. CAR, SCOOTER RENTALS DURING YOUR STAY
Please contact Rena from Aventura Car Rental, in case you would like to rent cars for the group, or in case students would like to rent cars or scooter during their stay.
PLEASE NOTE
If people need cars or scooters during their stay, please arrange with Rena at least 2 till 3 month ahead, depending the season (for July groups it is important to arrange at least 3 month ahead). All teachers and students need to tell that they are coming via THE EGG for best pricing!
